Terms of Service
Last updated: March 16, 2026.
Overview
By submitting payment or initiating a project with The DCP Company ("Company"), the client ("Client") agrees to the following terms.
Services
The DCP Company provides digital cinema mastering and related post-production services. Each project is custom and created from source materials provided by the Client.
Client Responsibilities
The Client agrees to provide final approved source files for all deliverables, verify that all submitted materials are correct and complete, and maintain backup copies of all submitted media. The Client confirms they have the legal rights to all content provided and that the materials do not infringe on any third-party rights.
Technical Standards
The DCP Company delivers DCPs according to current industry-standard SMPTE and/or Interop specifications. Playback performance may vary depending on projection equipment, server configuration, and venue conditions, and the Client is responsible for testing deliverables at their intended venue whenever possible.
Revisions and Corrections
If technical issues arise due to errors in the DCP creation process, The DCP Company will make reasonable efforts to correct them. Revisions requested due to changes in the source material provided by the Client may incur additional charges.
Payment
Payment must be made in full before final deliverables are released unless otherwise agreed in writing. Because services are custom and labor-based, projects are non-refundable once work has begun.
Data Handling
Project files are retained for one year after delivery unless otherwise arranged. While reasonable care is taken to safeguard client materials, The DCP Company is not responsible for corrupted uploads, incomplete transfers, or data loss resulting from third-party services or client-provided storage devices. Clients should maintain their own backups at all times.
Limitation of Liability
The DCP Company's liability for any claim related to services provided will not exceed the total amount paid by the Client for the project. The Company is not liable for festival rejection of deliverables, projection or playback issues caused by venue equipment, or indirect or consequential damages.
Project Acceptance
Clients should review deliverables promptly upon receipt. Any issues must be reported within 14 days of delivery.
Right to Decline Service
The DCP Company reserves the right to decline or terminate projects at our sole discretion, including but not limited to: projects that are incomplete or technically unsuitable, contain unlawful content, or violate these terms.
Governing Law
These terms are governed by the laws of the State of California. For further details please review the Privacy Policy, Data Handling & Security Policy, Service Agreement, and NDA. Questions may be sent to hello@thedcpcompany.com .
