Service Agreement

Scope of Services

This Service Agreement outlines the terms between The DCP Company ("Service Provider", "we") and the client ("Client", "you") for post-production services including Digital Cinema Package creation and related deliverables. The DCP Company agrees to provide the services selected by the Client at checkout and confirmed through the project intake form. Services may include DCP mastering, screener creation, subtitle or caption packaging, 5.1 audio channel mapping, festival drive preparation, and rush services when available. Deliverables and estimated turnaround times are defined per project and begin once all required materials have been received.

Project Start & Refund Policy

A project is considered started once the Client has submitted the master source files. Refunds may be requested prior to file submission. Once master files have been submitted and work has begun, services become non-refundable due to the custom and labor-based nature of post-production work. If an incorrect version of a film is accidentally submitted or a cancellation request is made before work begins, Clients should contact support@thedcpcompany.com as soon as possible.

Revisions & Redelivery

The DCP Company includes one round of minor revisions to correct technical issues related to the DCP creation process, such as framing or container mismatches, sync issues introduced during processing, or formatting and packaging corrections. Revisions do not include errors caused by improperly prepared source materials. If picture or audio changes are made after delivery, the project may be reprocessed at a discounted revision rate depending on scope.

Client Responsibilities

The Client agrees to provide final locked source materials suitable for mastering, deliver assets in the requested technical specifications, confirm framing, aspect ratio, and container format where required, and review proof screeners promptly while reporting issues within a reasonable timeframe. Clients acknowledge that the quality and technical accuracy of the final DCP depends on the quality and specifications of the materials provided.

Delivery & File Handling

Proof screeners may be delivered through secure review platforms such as Frame.io. Final deliverables may be provided through secure file transfer or physical media depending on project requirements. Client files are handled according to The DCP Company Data Handling & Security Policy and stored on encrypted storage during active production. Project files are typically retained for up to one year after final delivery unless otherwise requested.

Confidentiality

All projects are handled under the terms of The DCP Company Mutual Non-Disclosure Agreement. The DCP Company will not share, display, or reference Client projects publicly without written permission.

Payment Terms

Payment is due in full at the time of order unless otherwise agreed. Work will not begin until payment has been received. The DCP Company reserves the right to pause or cancel projects if communication or required materials are not provided within a reasonable timeframe.

Technical Environment Disclaimer

Digital Cinema Packages are created to comply with industry-standard SMPTE or Interop specifications. However, projection environments vary widely between venues, including differences in servers, projectors, and playback systems. The Client is responsible for testing the DCP with their intended venue or festival whenever possible, and The DCP Company is not responsible for screening issues caused by projection environments or equipment outside our control.

Limitation of Liability

To the fullest extent permitted by law, The DCP Company's total liability for any claim arising from services provided will not exceed the amount paid by the Client for the project. The DCP Company is not liable for lost revenue or missed festival opportunities, projection or server compatibility issues beyond our control, or indirect or consequential damages.

Governing Law

This agreement is governed by the laws of the State of California. Both parties agree to attempt informal resolution or mediation before initiating formal legal proceedings.

Acceptance

By submitting payment and providing project materials, the Client acknowledges and agrees to the terms of this Service Agreement.
